Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of GamesOnTv (the "Service"), provided by Games On TV LLC ("we", "us", "our"). By using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

2. The service

GamesOnTv sends SMS messages to bar managers and staff to help schedule televised sports content across the venue's TVs and providers. Recommendations are advisory; final decisions about what plays on your TVs are yours.

3. Eligibility

You must be at least 18 years old and authorized to receive text messages on the phone number you provide. By signing up on behalf of a business, you represent that you have authority to bind that business to these Terms.

4. SMS terms

By providing a phone number and opting in, you consent to receive recurring text messages from GamesOnTv. Message frequency varies based on your bar's schedule. Message and data rates may apply. Reply STOP to opt out, HELP for help. Carriers are not liable for delayed or undelivered messages.

5. Beta program

If you participate in our beta program, you understand that the Service is pre-release, may contain bugs, may change without notice, and is provided free of charge during the beta period. We may end the beta or change its terms at any time.

6. Acceptable use

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to interfere with or disrupt the Service; (c) reverse engineer or copy the Service; (d) provide a phone number you don't own or have permission to use; or (e) use the Service to send unsolicited messages to others.

7. Third-party content

The Service references third-party content (TV networks, sports leagues, providers, streaming apps). We don't control those services and are not responsible for their availability, accuracy, channel lineups, blackouts, or licensing. You're responsible for having the rights to display the content on your venue's TVs.

8. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied. We don't guarantee that game listings, channel mappings, or TV recommendations will always be accurate, complete, or available. Use the Service at your own risk.

9. Limitation of liability

To the maximum extent permitted by law, Games On TV LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) one hundred U.S. dollars ($100).

10. Indemnification

You agree to indemnify and hold Games On TV LLC harmless from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without notice, including if we believe you've violated these Terms.

12. Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Virginia.

13. Changes

We may update these Terms from time to time. If we make material changes, we'll let you know via email or SMS. Continued use of the Service after changes take effect means you accept the updated Terms.
